Update: CHP Officers Arrest 38 Drivers in OC as New Year’s Approaches

For the California Highway Patrol, the holiday DUI-enforcement period has begun.

Updated at 12:20 p.m. Sunday

CHP officers arrested 38 drivers for suspicion of DUI in Orange County during the first 36 hours of the New Year’s holiday period, compared with 57 last year.

One person was killed on county roadways between Friday at 6 p.m. and Sunday at 6 a.m., according to the CHP. There were no traffic fatalities reported in the same time frame in 2011.

The 36 DUI arrests only include those made by CHP officers and do not include arrests made by other law enforcement agencies.

Statewide, there were nine traffic fatalities from Friday night to Sunday morning, compared with 12 during the same time in 2011. CHP officers arrested 723 drivers for suspicion of DUI, compared with 932 last year.

In San Diego County, 47 drivers were arrested by the CHP for suspicion of DUI, and one person was killed in a wrong-way crash on state Route 52 in Santee that is suspected of being alcohol-related.

If people would call a cab or use a designated driver we wouldn't have a problem. The FACT is - most DON'T and that's why drunk driving is a PROBLEM. But because people don't call a cab or use a designated driver I - A LAW-ABIDING MOTORIST - should not be punished for it by being forced to submit to unwanted police interrogations or searches WHEN I HAVE DONE NOTHING WRONG!!! Get it??? It's really not that hard to understand. If you want to forfeit YOUR civil liberties then be my guest. But don't TELL ME THAT I MUST FORFEIT MINE!!!! When your stink contaminates my clothes, that's when I complain. I don't want to play by the totalitarian rules that you propose. So go play by yourself. But don't order the rest of us to play by YOUR game. Got it??? That's called 'fascism'.

JustUs...have you gone through a sobriety checkpoint? If so, please explain how you were subject to a warrantless search. Is asking for you driver's license and a simple question of whether you consumed alcohol a "police interrogation"? Since checkpoint locations are advertised prior to their implementation and all checkpoints have an "escape" prior to entering them, you have a choice not to be in the area or go through the checkpoint. As to deflection, you seem to be leading the charge by being dismissive of others and not answering questions posed to you by stating they are "really dumb". Do you really believe that bars are the primary source for DUI's? They certainly are a part of the problem, but so are people drinking at restaurants, parties, etc. I am sure you will ignore or dismiss the comments made by myself or others as "really dumb", but I think the rest of the posters here can see the light.

The FACT is that INNOCENT LAW-ABIDING TAXPAYERS are FORCED to SUBMIT to police actions at DUI checkpoints. You can attempt to downplay the intrustions if you want - but being FORCED to SUBMIT when following all the laws is the key here. That is NOT the design of a FREE society. So stop with the slippery slope garbage. Posting an opinion here is a privileged opportunity, enough with utilizing this forum to banter in an argumentative fashion. We are adults and need to and should take responsibility for ourselves, and when we are not able to or see a friend or patron not capable, do something proactive to rectify a potentially dangerous situation. Offer someone a ride by calling a taxi or someone sober to pick up, do what each individual situation requires not to allow drunks to drive! (Most of my sphere leave their homes in a taxi when the plan is to go to a party so the car remains in the garage!) Just say no...friends don't let friends drive drunk! Being proactive and obeying the law allows no fear of going through a DUI check point, they are welcomed!

By the way, sadly I do know a few folks that have been arrested for DUI's. they were pulled over for minor traffic infractions that many of us are guilty of everyday: failure to make a complete stop at a stop sign or red light, crossing the line due to distraction of lighting a cigarette, or fiddling with the stereo. They blew the minimum at .08 and were arrested. So it's really not worth it when you are subject to being pulled over for anything: even as simple as no front license plate.

That's what makes us different from North Korea or Red China were civil liberties are non-existent. Innocent law-abiding motorists should not be forced to the side of the road to undergo intrusive police action in a 'free' society. That is common sense. Those who have immigrated to America from third world banana republics and dictatorships see this and it sends a cold shiver up their spines. There are much more efficient and effective ways to catch drunk drivers than by harassing and infringing upon the civil liberties of innocent, law abiding taxpaying citizens.

Your original comment said that if a motorist does not exhibit the signs of intoxication that he would be waved through the checkpoint. Yet, I pointed out to you that if a driver had a gun and an ILLEGAL currency printing press on his passenger seat that the cop would immediately order him to get out of the car - even though he wasn't drunk. DUI checkpoints treat INNOCENT LAW-ABIDING CITZEN LIKE COMMON CRIMINALS. Again, that is stuff I would expect to see in NORTH KOREA, not in the United States of America. You aren't familiar with how fascist societies get their start. You must think that one morning everyone gets out of bed and a fascist government is in power. You aren't smart enough to understand that fascism is a product of incrementalism. That is, it infects a society gradually - like the frog that gets cooked in the pot on the stove by gradually turning the burner up higher and higher. It's a shame that the public school education is so deficient in this day and age. Obviously, they teach you nothing about the US Constitution of the importance of it. Most fatal collisons are caused by drunken drivers with previous convictions of same. Most of them drink at bar and after their money runs out or the bars close their doors the drunks get into their cars and hit the roads. But obviously you don't have the grey matter to understand these simple facts or to connect the dots. Must be educated in a public school.
