More Homeowners Filing Against City Over Flood Damage

The City Council is scheduled to deny the claims at its meeting April 3.

Three more San Juan Capistrano homeowners are filing claims against the city, alleging it is responsible for damage to their properties when they were flooded Dec. 22.

The City Council is slated to deny each of the claims filed by Mohammed Erashadi, Thomas and Donna McDonald and Greg and Julie Johnson at its meeting Tuesday, which could pave the way for lawsuits.

Erashadi alone is seeking more than $100,000, saying he believes the city failed to maintain storm drains near his property, causing water to back up and flood his home.

In their claim, the McDonalds say that “complaints had previously been lodged with the city concerning the silt buildup, which the city ignored,” and that the “city was previously on notice that the drain system was not properly diverting water, mud and other debris from the property and/or adjacent properties during heavy rainfalls.”

Claims filed by the McDonalds and the Johnsons do not state how much money they are seeking.

The council's denial of the claims will be based upon recommendations from its insurance adjuster, Carl Warren & Co., a memo from staffers states.
