Father Facing Numerous Charges for Accident that Killed Daughter

Antolin Brito Soto is accused of having a blood alcohol content of .18 percent one hour and a half after the crash.

A San Juan Capistrano man who lost his 5-year-old daughter in an alleged alcohol-influenced accident on March 22 will be in court today, facing numerous charges which could send him to prison for as many as 20 years.

Antolin Brito Soto was driving westbound on Junipero Serra Road with four children in his Ford Explorer when it went through the parking lot of the Silverado Senior Living complex, then went airborne after hitting a curb, landing on an embankment.

“Soto is accused of displaying objective signs of intoxication and had a blood alcohol content of .18 percent one hour and a half after the crash,” according to an Orange County District Attorney’s office press release.

Daughter Yuliana Brito was rushed to Mission Hospital, where she was pronounced dead.

Three other children, Ayleen, 2, Arthur, 8, and Iriana, 12, were also hospitalized, according to the Orange County District Attorney’s office.

Soto is charged with one felony count each:

  • Vehicular manslaughter with gross negligence while intoxicated
  • Driving under the influence of alcohol causing bodily injury
  • Driving with a blood alcohol content of .08 percent or more causing bodily injury
  • One misdemeanor count of driving on a suspended license
  • Sentencing enhancement allegations for personally inflicting great bodily injury, causing bodily injury and/or death to multiple victims
  • Sentencing enhancement allegations for driving with a blood alcohol content of .15 percent or more
  • Sentencing enhancement allegations of great bodily injury to a child under five years old
