Prosecutor: Hockey Mom Provided Sex, Alcohol to Teens

Details emerge how Kathia Davis allegedly seduced a 13-year-old and 16-year-old, both friends of her son.

A 45-year-old hockey mom had sex with her son's 16-year-old teenage friend in her "party house" in Laguna Niguel and on another occasion sexually assaulted a younger teammate while her kids dozed off watching TV nearby, a prosecutor told jurors Tuesday.

But while Kathia Maria Davis' attorney acknowledged his client had sex with one of the teenage friends, she denies she ever molested the younger boy or provided him with alcohol.

Deputy District Attorney Jennifer Walker alleged Davis "provided alcohol" to the 13-year-old and her son, and after the boys dozed off, "put her foot on (the victim's) crotch and asked him for a foot massage."

Davis then allegedly masturbated the boy and kissed him before the two started "dry humping," with the defendant's hiking shorts "acting like a condom," Walker said.

Later, as the boy began to "sober up," he felt what they did was "not right," so when Davis tried to perform oral sex on him, he rolled over instead and she stopped, Walker told jurors.

Sometime in 2005, several months after the alleged sexual assault, the boy told his sister that the defendant "touched him down there," and she told
their mother, the prosecutor said.

When the mother confronted Davis, "the defendant did not deny" it and said she was "going through a hard time," Walker said.

Orange County sheriff's investigators did not find out about the accusations regarding the 13-year-old until another alleged victim came forward last year, according to Walker, who said Davis' home became known as "the party house" where the hockey players could have easy access to alcohol. 

"Being 16, (the second alleged victim) thought that was fun," Walker said.

After "much flirting," with comments about his "six-pack," Davis is accused of inviting the boy to her room for sex in the summer of 2010, Walker said.

Indignant parents confronted Davis at some point about the parties at her home and she promised to dial it down, Walker said.

Last summer, the boy and Davis had sex again on a couple more occasions, Walker said, and the boy eventually told his mother.

The mother "became irate that her ... son was having sex with a woman 25 years older, a woman she thought was her friend,'' Walker said.

When Davis failed to return the mother's phone calls, she sent text messages to the defendant, Walker said. The mother issued an ultimatum: Cease any contact with her son or else she would go to law enforcement, Walker said.

When her son later told his mother to stop "harassing" Davis, the woman reported the allegations to the defendant's ex-husband, who reported the accusations to deputies, Walker said.

Confronted by investigators, Davis denied having sex with the older boy, but then later acknowledged it, Walker said.

Davis alleged the younger boy "came on to her and she rebuffed him," Walker said.

Defense attorney David Cohn told jurors that his client has consistently denied initiating any sexual contact with the younger boy.

The boy and Davis' son "got into alcohol" in the house and got drunk, Cohn said.

As the two boys and Davis' daughter were watching TV and were dozing off, the 13-year-old tried to kiss Davis, Cohn said.

"She shoved him away and said, `What the heck are you doing? This ain't happening. You've had too much to drink,' " Cohn said.

Davis felt compelled to tell the boy's mother what happened, but was "leery" because she was concerned that he had gotten drunk during a stay at her home, Cohn said.

The defense attorney said even after the incident, the boy's mother planned a trip to the Bahamas for her family and Davis' family.

Davis assumed that the older boy was 18 years old, like her son, when they had sex, Cohn said. The alleged victim had a Facebook profile that indicated he was 19, according to Cohn.

The defense attorney also denied his client supplied alcohol to the hockey players, saying the youths sneaked booze into the parties and would play "beer pong" in a garage while the adults were elsewhere in the house.

The older boy "became enamored of Kathia" and started sending his "crush" text messages, saying he wanted to have sex with her, Cohn said.

Davis, at the time, was going through a "tumultuous divorce," and eventually gave in to the boy, Cohn said.

Davis is charged with four felony counts each of lewd acts on a child younger than 14 and unlawful sexual intercourse, along with sentence-enhancing allegations of substantial sexual conduct with a child.

She is also charged with three misdemeanor counts of contributing to the delinquency of a minor and faces up to 17 years and eight months behind bars if convicted.
